CFTC Sues Utah to Block Prediction-Market Enforcement

The CFTC has sued Utah in a move aimed at stopping the state from pursuing its case against Kalshi and from enforcing gambling rules against CFTC-regulated prediction markets. The action makes Utah the tenth state named in the agency’s wider push to defend federal control over prediction markets, while Utah’s own case seeks to recover up to $60 million tied to event contracts.

What it means
Kalshi and similar exchanges list 'event contracts' on elections, sports and other outcomes as CFTC-registered derivatives under the Commodity Exchange Act, the same framework that covers futures on oil or interest rates. Several states, treating those contracts as wagers, have moved to shut them down under local gambling statutes. Utah's case against Kalshi, filed last week, is the latest in a string of such actions that now stretches to ten states.
If the CFTC's suit succeeds, Utah cannot pursue its own case or recover the up to $60 million in profits it says Kalshi made from event contracts in the state. Kalshi and market-maker Susquehanna keep operating there without a state license, and Utah's gambling regulator loses its enforcement tool against both firms. A loss for the CFTC would instead let Utah's claim proceed and give the other nine states a template to revive their own actions.
More than a dozen legal actions in, the CFTC is trying to settle who gets to call a contract a commodity rather than a bet, and the answer will decide whether state gambling law reaches federally listed products at all. The agency casts itself as the sole regulator of these markets; state attorneys general counter that Washington cannot override local gambling bans by relabeling them. Both claims have real legal grounding, which is why the fight has reached ten statehouses rather than one.
The Utah case, filed in federal court after the CFTC's October 27 complaint, is now the test for whether the agency's preemption argument holds beyond a single state. A ruling in the CFTC's favor would likely fold the other nine state disputes into the same legal logic; a ruling for Utah would hand gambling regulators grounds to keep pressing Kalshi state by state while the appeals play out.
